Intermediary service provider
The store through which the purchase is made: Apple Distribution International Ltd. for the App Store, and Google for Google Play. Their legal names and addresses are given in the Pre-Information Form.
2. Subject
This agreement sets out the rights and obligations relating to the Premium subscription or the Educator Pack service that the buyer purchases in the BlueGrays app through the App Store or Google Play, in accordance with Consumer Protection Law No. 6502 (Tüketicinin Korunması Hakkında Kanun), the Distance Contracts Regulation (Mesafeli Sözleşmeler Yönetmeliği) and the Subscription Contracts Regulation (Abonelik Sözleşmeleri Yönetmeliği).
The Pre-Information Form and the Subscription and In-App Purchase Terms form an integral part of this agreement. In case of conflict, the provision more favorable to the consumer applies.
3. Service, price and date
- Service: The product the buyer selects on the purchase screen: Premium monthly, Premium yearly, Premium with a personal offer, or the Educator Pack (5 or 10 codes, 30 or 365 days).
- Price: The amount, including all taxes, shown on the purchase screen and in the store's confirmation window right before the payment is confirmed. For a subscription, this is the amount charged for each billing period.
- Agreement date and service start date: The date on which the store confirms the purchase. This date appears on the store receipt and in the membership details of the buyer's account.
- Payment: The store charges the payment method registered in the buyer's store account.
4. Performance
Premium is activated in the buyer's account as soon as the payment is confirmed. Educator codes are delivered to the My Codes page right after the purchase. If delivery is delayed, the buyer reports it to [email protected], and the issue is fixed as soon as possible.
5. Subscription term, renewal and termination
- Premium is a subscription that continues until the buyer cancels it. The fee is charged in advance for the chosen period (month or year). Unless the buyer cancels, the subscription automatically renews for the same period at the end of each period, and the fee for the new period is charged. Having been informed on the purchase screen, the buyer requests this renewal by confirming the purchase.
- The buyer can terminate (cancel) the subscription at any time, without giving a reason and without paying any penalty, in the subscription settings of the store where the subscription was started. The termination method is no more burdensome than the method by which the agreement was concluded. Termination takes effect at the end of the paid period, and no fee is charged for later periods.
- The buyer's rights under the Subscription Contracts Regulation, including a refund of the fee for the period remaining after termination, are reserved. The buyer can send such requests to [email protected].
- The Educator Pack is a one-time purchase, not a subscription, and does not renew.
6. Right of withdrawal
Because the services covered by this agreement are performed instantly in electronic form and the intangible goods are delivered instantly, the buyer has no right of withdrawal under Art. 15(1)(ğ) of the Distance Contracts Regulation. By confirming the purchase, the buyer agrees that the service starts immediately and confirms having been informed of this before the purchase.
7. Defective service
The service is provided in line with the features stated in this agreement and in the Pre-Information Form. If there is a defect caused by the service provider, the buyer can use the optional rights under Article 15 of Law No. 6502: having the service performed again, a price reduction, or withdrawal from the agreement. Notices are sent to [email protected].
8. Obligations of the parties
- The service provider provides Premium and the codes in line with the scope of the purchase, fixes service interruptions as soon as possible, and keeps purchase records for at least 3 years.
- The buyer uses their account and Premium access in line with the Terms of Use. If the buyer is under 18, they get the consent of a parent or legal guardian for the purchase.
- A buyer who purchases an Educator Pack distributes the codes in line with Section 9 of the Subscription and In-App Purchase Terms.
9. Force majeure
For as long as events beyond the parties' control continue, such as natural disasters, epidemics, war, widespread internet or power outages, and decisions of public authorities, the parties cannot be held liable for failing to perform the obligations affected. If the disruption lasts a long time, the buyer's statutory rights are reserved.
10. Records and evidence
The store's records of the purchase and the service provider's electronic records may be used as evidence in disputes under Code of Civil Procedure No. 6100 (Hukuk Muhakemeleri Kanunu). This provision does not limit the buyer's right to present counter-evidence.
11. Dispute resolution
This agreement is governed by the laws of the Republic of Türkiye. Disputes can be brought as follows:
- Below the monetary limit announced each year by the Ministry of Trade, to the Consumer Arbitration Committee (tüketici hakem heyeti) where the buyer lives or where the transaction took place,
- Above that limit, to the consumer court where the buyer or the service provider is domiciled, after mediation, which is a mandatory prerequisite for filing a lawsuit.
12. Entry into force
The agreement is concluded and takes effect when the buyer reads the Pre-Information Form and this agreement on the purchase screen and confirms the purchase. The current version of the agreement is available in the app under Profile > Preferences > Agreements and on bluegrays.com.
